NEWARK<\/strong> – Those who may be concerned that the President Donald J. Trump Administration will deploy the National Guard, the U.S. Marine troops and other federal agents for crime reduction here like in Los Angeles and Washington, D.C. may be breathing a little easier with a federal judge’s Sept. 2 ruling in San Francisco that tentatively barring at least the L.A. deployment.<\/p>\n\n\n\n

Federal Judge Charles Breyer ruled from his U.S. District Court-Northern California District bench Tuesday morning that President Trump and Defense Secretary Pete Hegseth’s June deployment of some 700 Marines and 4,000 National Guard troops had violated the 1878 Posse Comitatus Act. The act keeps federal troops from being used for domestic law enforcement.<\/p>\n\n\n\n

The ruling is a response to California Gov. Gavin Newsome filing a complaint June 6 and seeking relief from Trump and Hegseth sending the troops in June in response to the anti-deportation demonstrations in three of Los Angeles blocks. The Trump Administration sent in the troops over the objections of Newsome and Los Angeles Mayor Karen Bass’ objections that they were unnecessary. Guard troops, down to 700 as of Sept. 2, guarded downtown federal buildings.<\/p>\n\n\n\n

“President Trump’s recent executive orders and public statements regarding the National Guard raises serious concerns as to whether he intends to order troops to violate the Posse Comitatus Act elsewhere in California,” said Breyer in his ruling. The judge was referring to Trump’s public comments on sending to Oakland, Calif., Chicago, Baltimore and New York City.<\/p>\n\n\n\n

While Breyer’s ruling intends to prevent turning the National Guard “into a national police force with the President as its chief,” the judge barred enforcement until Sept. 12 to allow the U.S. Department of Justice to file an appeal. Breyer added that his ruling pertains to California — and not the current deployment in Washington, D.C. or elsewhere.<\/p>\n\n\n\n

Trump’s speculative deployments to Chicago, Baltimore and New York have raised hackles by officials in those locales. Chicago Mayor Brandon Johnson, for example, signed an executive order clarifying when and how that city’s police will assist or not assist with federal level law enforcers.<\/p>\n\n\n\n

“This order affirms that the Chicago Police Department will not corroborate with military personnel on police patrols or civil immigration enforcement,” said Johnson Saturday. “We will not have our police officers, who are working hard every single day to drive down crime, deputized to do traffic stops and checkpoints for the President.”<\/p>\n\n\n\n

New York Police Commissioner Jessica Tish and Gov. Kathy Hochul said that they have respectively called U.S. Attorney General Pam Bondi and Trump on Aug. 25 and 23 that sending the National Guard or other federal agents into the nation’s biggest city is unnecessary.<\/p>\n\n\n\n

“I said, ‘Mr. President, I can give you all the data you need to show that crime is down, our policies are working; NYPD is doing its job, ” said Hochul Saturday. ” ‘We did our job in the State Legislature to tighten up laws that had gone way too long being loose.’ ”<\/p>\n\n\n\n

The Trump Administration has targeted Los Angeles and Washington, D.C. – the country’s second and 22nd largest cities by population – to reduce crime. Trump called the National Guard and U.S. Marshals into Washington and took federal control of the district’s police in the wake of an Aug. 7 attempted carjacking which left a former DOGE official injured.<\/p>\n\n\n\n

Some observers noticed that the cities, including the federal district, have Democratic party mayors and council majorities – and so does Newark.<\/p>\n\n\n\n

Newark seeing National Guard troops in New Jersey’s largest city without the mayor or governor’s consent is a practical non-starter.<\/p>\n\n\n\n

First, other cities would be receiving federal troops long before Newark does.<\/p>\n\n\n\n

Newark, at 311,549 residents in the 2020 U.S. Census, ranks as the nation’s 64th most populous city. Baltimore, at 595,000, is ranked 30th and Oakland, at 449,000 is ranked 44th.<\/p>\n\n\n\n

“Local Talk,” by comparing the top 65 cities to Ballotpedia website stats, finds that 44 of their mayors are Democratic party affiliated. Ten are Republican party affiliated with the rest being either independent or nonpartisan.<\/p>\n\n\n\n

Newark, according to 2024 New Jersey Justice Department Uniform Crime Statistics, has an overall decline in crime from 2023 – similar to what Los Angeles, New York, Baltimore, Chicago, Oakland and Washington have found.<\/p>\n\n\n\n

A further look shows that violent crime is down nine percent from 2023 – including the lowest homicide rate since the 1940s. There has been, however, a four percent increase in property crime.<\/p>\n\n\n\n

Then there is what Newarkers experienced during the July 12-17 riots\/insurrection\/social disorder. The New Jersey Army National Guardsmen and tanks were called in by Gov. Richard Hughes at its height to assist Newark and State police. The official casualty toll stands at 26 dead, 727 injured and 1,465 arrested.<\/p>\n\n\n\n

The NJNG had only six hours of “riot training,” and were mostly inexperienced in urban settings. Some Guardsmen responses ranged from violent to lethal. One incident, where a Guardsman shot at what he thought was a building sniper, supposedly killed a four-year-old girl.<\/p>\n\n\n\n

The state’s National Guard was also called into the July 14-16 Plainfield riot or uprising until July 21 to search homes for “stolen rifles.” Plainfield Police Off. John Gleason was killed and there were 150 recorded arrests.<\/p>\n\n\n\n

Michigan\u2019s National Guard was likewise called in during Detroit’s July 23-28, 1967 riot or uprising. President Dwight D. Eisenhower called in the Army 101st Airborne to Little Rock, Ark., in September 1957 to integrate its high schools and to counter resistance by the Arkansas National Guard.<\/p>\n\n\n\n

Hochul, in her March 2024 emergency declaration on the New York City subway system, brought that state’s National Guard in to conduct bag checks with the NYPD and provide a visible presence. It was part of a five-point plan at the time to tamp down on a violent crime surge.<\/p>\n\n\n\n

Trump meanwhile signed an executive order Aug. 25, directing Hegseth to have at least one unit of each state’s Army and Air National Guard “specifically trained and equipped to deal with public order issues.”<\/p>\n","protected":false},"excerpt":{"rendered":"
