District Judge Matthew Brann had ruled from his Harrisburg bench that Friday that Habba had been “unlawfully serving” as “Acting” New Jersey District attorney since July 1. Brann, in his 77-page ruling, said that the U.S. Attorney General Pam Bondi and President Donald J. Trump “acted improperly” by naming Habba as acting attorney without having her go through the federal appointment and Senate Judiciary Committee vetting process.

Brann basically saw the Trump Administration’s attempted end around of what could have been a permanent Habba appointment July 24-25 the same way Thomas Mirigliano, Esq. and his client, Julien Giraud, Jr. saw it. The New York City lawyer is representing Giraud, who is facing a federal trial on drug and weapon possession charges.

Mirigliano and Giraud were among five plaintiffs who questioned the legality of the Trump Administration’s effort to make Habba “Interim” Attorney. The normal approach is that the 120-day interim attorney’s name is brought forward by federal judges to the Senate committee. Those judges, instead, recommended assistant attorney Desiree Grace July 22.

Brann, while ruling that Habba, of Summit, has no authority and should be separated from ongoing federal cases, put a stay on his order. The judge is anticipating the Trump Administration filing an appeal.

Habba’s portrait is still on the USDOJ -New Jersey District website. Grace remains fired by Trump/Bondi since July 24. and U.S. vs. Giraud remains imminent but without a jury selection for trial starting date set.

NEWARK – Public Safety Director Emanuel Miranda Sr. reports the arrest of Darryl Armstrong, 48, of Elizabeth, who falsely reported to police that he was robbed at gunpoint on August 22, 2025.

Detectives responded to the incident, which allegedly occurred on Springfield Avenue and South 15th Street. Armstrong told detectives that three males wearing all black clothes exited a black four door vehicle, pointed a weapon at him, threw him to the ground, and took his cellphone.

During the investigation, the detectives reviewed surveillance video that showed Armstrong was not robbed. At approximately 2:29 p.m., he was standing on the sidewalk on Springfield Avenue, where he ran into the middle of the street and grabbed the door handle of a white SUV vehicle. He lost his grip and fell face first to the ground. Moments later, at approximately 3 p.m., Armstrong was stumbling as he walked into a liquor in the 600 block of Springfield Avenue to call police for assistance.

He was treated at University Hospital, where he again told detectives that he was robbed at gunpoint. Armstrong was arrested and charged with false swearing.

These charges are merely allegations. The suspect is presumed innocent until proven guilty in a court of law.

EAST ORANGE – City and county detectives are investigating the circumstances of an Aug. 19 shooting in the Fifth Ward that injured a man.

The first East Orange Police Department units were responding to a shooting report from 321 Park Ave. at about 11:06 p.m. that Tuesday. They arrived to find “a man with a gunshot wound to his face” between North. Munn and North Arlington avenues.

Local EMS medics rushed the victim to Newark’s University Hospital for treatment. He was last reported as being in stable condition as of Aug. 20.

EOPD officers, joined by county detectives, located a .9mm handgun from where the victim was found.

321 Park is where the 1940-built Park Terrace Apartments stands. The four-story building was redeveloped by PTGH-EO Urban Renewal, LLC and is managed by Benjamin H. Realty Corp.

ORANGE – Those heading on northbound Scotland Road have seen a billboard honoring former Orange High School Tornadoes football player D’Andre Smith on the one-year anniversary of his murder.

The Upfront billboard features Smith’s portrait flanked by two photos of him in action as OHS Tornados player No. 21. His name, Aug. 10, 1996 – Sept. 15, 2024 dates are centered above “Legends Never Die.”

Smith, 28, died from a gunshot wound to his leg while at Newark’s University Hospital 7:26 p.m. Sept. 15. He was taken there by local EMS after Orange police officers had found him and a second shooting victim on Metcalf Park’s baseball diamond, off Valley and Morris streets, 8:35 p.m. Sept. 12.

A suspect – Brandon D. Beasley, 24 – was apprehended Sept. 12 after a car and foot chase. He has been charged with resisting arrest and weapons and stolen vehicle possession charges. The second victim was treated for a gunshot wound to his hand and was released.

Smith, who was born Aug. 10, 1996, graduated with the Orange High School Class of 2014. He played in his sophomore-senior seasons as a Tornado defensive back and wide receiver. He was on teams who amassed an 11-12 win-loss record.

Smith’s visitation and service were held at Newark’s Cotton Funeral Home Sept. 26.

WEST ORANGE – Councilwoman Joyce Rudin, at the council’s Aug. 20 meeting questioned aloud to her colleagues, administration and public how much temporary exterior lighting at the new West Orange Public Library should cost.

“We’re renting these large machines outside our public library that run on diesel (fuel), “said Rudin. “They’re illuminating the outside of the library and we’re paying, I believe, $5,000 a month for this.”

When Council President Joe Krakoviac said that he thought the monthly cost was $700, Rudin responded with, “We had two bills and the total was $5,000 – but I don’t think that one is for the (diesel generators’) rentals at the library. If I’m wrong, then it’d be $2,300 each.”

Interim Business Administrator Peter Smeraldo said that the three portable diesel generators with lighting cranes were placed because “most of the lights were broken.” The overall replacement of exterior lighting, part of the WOPL’s 10 Rooney Circle building upgrade, would cost between $40,000 and $50,000.

West Orange Health Director Michael Fonzino, on Aug. 21, announced that he and the Essex County Health Commission had investigated the portable diesel light towers based on an anonymous complaint filed to the township and the NJ DEP. Fonzino and ECHC found that each of the three generators “operate at 5.2 kilowatts, far below the 37kW threshold necessary to require an NJ DEP air pollution control permit.”

The WOPL’s two floors of the four-story 1970s 10 Rooney Circle building is being upgraded in part to satisfy an Americans with Disabilities Act access requirement. The library was closed for a week to have a burst sewer main replaced.

SOUTH ORANGE – What started as a Village Center “Ceasefire Sunday” demonstration March 31, 2024 ended in municipal judge’s Aug. 15 ruling on two Palestine Village Center protestors. and the clearing of the Maplewood Police and Court Ruling.

Village Judge Jonathan H. Rosenbluth ordered the clearing of the courtroom gallery when some of the audience “reacted loudly” to his finding Lisa Davis, of West Orange, guilty of holding a special event without a permit and of using sound application equipment for loud, continuous or excessive noise. The gallery removal was made while Rosenbluth discussed the sentencing with Village Prosecutor Gracia Montulis (better known as Orange Municipal Attorney) and defense attorney Joseph Fortunato.

Davis and Fortunato’s defense is that she was not asked for permits or whether she was an organizer of the event at Spiotta Park. She maintained that she was not an organizer because the rally did not have one and that no one else there received a summons. Although her own supplied video had her holding a bullhorn, she could not have shouted “Free Palestine” from it since she arrived 40 minutes after the rally’s start.

“I’m not here to determine what’s a good or a bad cause,” said Rosenbluth in his ruling. “Free speech has to be within the (village’s) regulations to control the means by which the message” is disseminated. “If it was to control the message itself, then it’d be a different story.”

“Does a participant have the same responsibility as an organizer at a protest with no permit obtained?” asked Rosenbluth. “Yes – or else everybody would protest at all times.”

Rosenbluth ultimately ordered Davis to pay $200 in fines and $33 in court costs for not having a permit plus $100 and $33 for the noise amplification complaint. What brought the gallery’s verbal objections was when Montilus asked the judge to fine Davis not the $2,000 maximum for each charge but not too low to deter any re-offense.

Davis told a reporter there that she intends to appeal to the (village) Law Division “for a trial de novo (new trial) based on the record that was created.”

MAPLEWOOD – Parents and other motorists will not be dropping off or picking up students in front of Columbia High School, between Valley and Parker streets, as of the Sept. 2 First Day of School.

Drivers may want to remember 7:15-8:15 a.m. and 2:10-3:10 p.m. for most of the rest of the 2025-26 school year. South Orange-Maplewood School District, with South Orange Police Department permission, will have Hixon Place at Valley Street and Sherman Place at Prospect Street closed at those times. Maplewood Police will simultaneously make Academy Street, North Terrace and Kensington Terrace one-way.

Permitted dropoff and pickup zones will be:

Southbound Academy Street between Sherman Place to Parker; Southbound North Terrace between Parker and Franklin Place.

Both sides of North Terrace between Franklin and Edgewood places.

Northbound Valley Street “just north of Parker Avenue” and CHS’s south building face. These lights are part of the $270,000 Parker Avenue Bike Lanes project that overlaps but is separate from the new CHS Circulation Plan.

The new plan – similar to ones employed in 2024-25 around Maplewood Middle and Tuscan Elementary schools – is intended for the new school year but will start as a six-week pilot subject to later refinement. Maplewood Committeeman Victor de Luca said that a traffic study there noticed students dropped off across Parker and Valley having to walk across opposing traffic, slowing all around circulation.

Parker Avenue’s “No Drop Off Zone” is one or two blocks of the 17-block, two-mile Parker Avenue Bike Path between Irvington and Maplewood avenues. There will be a shared west- and east- bound curbside lane along Parker with the appropriate installation of “No Parking” signs. There will be a westbound shared space before 113 Parker to accommodate Maplewood Jewish Center’s preschoolers.

UPDATE: The South Orange-Maplewood Board of School Estimate, at the request of the South Orange-Maplewood Board of Education Aug. 21, postponed its intended Aug. 27 public meeting to an unspecified date. He showed them a cell phone screen shot of a radar map of the approaching storm front.

“I asked the clubhouse and the starter (who sets golfers off on their rounds), ‘Are you guys going to blow a horn or something?” said Lakind, a Watsessing section resident. ‘The weather’s coming in, it looks pretty bad.’ I was told, ‘It’s not my problem.’ “

Borough police, responding to a lightning strike there, found a man, 36, between the second and 16th holes unconscious and not breathing – and bystanders administering CPR. FPPD and arriving Florham Park First Aid Squad and Atlantic Health medics took over CPR duty until the victim’s arrival at Livingston’s Cooperman Barnabas Medical Center. His condition upon his admission was last listed as critical.

Pinch Brook GC, whose roots go back to 1921, is an 190-acre, 18-hole course. It became Morris County Parks Commission property in 1985.

Most open air sporting events and concerts evacuate the public whenever a lightning strike is reported at least eight miles away from the venues. The Indianapolis Motor Speedway, for example, cleared out some 340,000 grandstand and infield spectators for four hours before starting its 108th Indianapolis 500 May 26, 2024 when lightning was seen eight miles to its northwest.

MONTCLAIR – A township man received Ft. Scarano, 23, said Bergen County Prosecutor Mark Musella Aug. 16, was handed a search warrant by town and county officers that Thursday over an Aug. 13-14 bias-oriented hacking and messaging of Atrium Palace condominium residents.

Complaints made by 411 African American and Jewish residents told of receiving emails “of bias and threatening language” over the condominium’s inhouse communication system. A preliminary investigation traced the emails to Scarano’s IP address.

The house search yielded “two different electronic devices to unlawfully access the online management and communication system and send biased, threatening messages.” The devices were confiscated as evidence.”

Scarano was arrested and charged on third-degree counts of making terroristic threats, computer criminal activity and creating a false public alarm and second-degree bias intimidation He was being held, as of Aug. 16, pending a first appearance in State Superior Court-Hackensack.

Musella thanked ECPO and the Montclair and Millburn police departments, among others, for their assistance in this case.

BELLEVILLE – Incoming and returning Belleville Public School students and parents have until Jan. 1 to comply with a new dress code that the Board of Education Trustees had passed during their Aug. 18 meeting.

It will help middle and high school students and staff have their smiles ready for their 2025-26 school year identification photos starting on Sept. 4’s first day of school.

BPS superintendent Dr. Erick Alfonso issued an Aug. 19 letter to the school community stating that the board the night before had passed revisions to dress code policy 5511 and student ID policy 5517. Dr. Alfonso explained that he is giving students four months’ slack in complying to the new dress code.

“Many of you have already purchased clothing and supplies for the upcoming school year and we want to recognize that effort,” said Alfonso. “That’s why the board has implemented a transitional period: during the fall, schools will provide information sessions, answer questions and support families as we prepare together.”

The new Belleville Middle and High school staff and student photo ID cards, however, will be produced as soon as possible. Dr. Alonso said that the district photographer will be visiting both schools starting Sept. 4 to take headshots prior to card production.

It is presumed that 2024-25 BMS and BHS ID cards will be honored in the interim.

NUTLEY – Nutley Police Department’s altering their Lyndhurst colleagues of a stolen car coming to their town Aug.13 led to its driver and passenger’s arrest.

The Nutley Police dispatcher had received an all points bulletin at about 5 a.m. that Wednesday a black Hyundai Sonata with Pennsylvania license plates that was reported as stolen from South Brunswick. Patrolling officers noticed a vehicle matching the description moments later — and the suspected vehicle seemed headed east for the DeJessa Memorial Bridge over the Passaic River.

The NPD headquarters dispatcher called Lyndhurst police of the incoming car – whose image was captured by that town’s fixed Automated License Plate Reader Camera mounted by the bridge and the Kingsland and Riverside avenues’ intersection.

Four LPD squad cars caught up with the Sonata at their Kingsland and Stuyvesant avenues. They arrested driver Breyonshe Wedd., of South Hill, Va., and passenger Veelique Farrior-Harris, of Newark for possession of stolen property.

Although Wedd was released with a hearing date, Ferrier-Harris was remanded to Hackensack’s Bergen County Jail for having an active warrant from Parsippany-Troy Hills for obstructing the administration of law.

TOWN WATCH IRVINGTON – The attorney representing his Irvington client may have received a victory in a federal judge’s Aug. 21 ruling on New Jersey Acting Attorney Alina Habba’s status – but he and his client are among other U.S. Department of Justice – New Jersey District defendants left in limbo.
