She and Kieonna Jones, 40, were struck in Clinton Place by a 2014 Ford Econoline in front of George Washington Carver Elementary School at about 9 p.m. that Monday.

Both Montgomery and Jones were rushed to University Hospital – where Montgomery was declared dead. Jones was admitted in stable condition.

Newark police and the ECPO Homicide/Major Crimes Unit were starting their field investigation, detouring NJTransit Route No. 13 buses and other traffic, when the said van and its driver returned to the scene. The driver – identified as Segundo Carlos Bunay, 33 – refused to take a sobriety test.

Bunay is being held on two third-degree counts of endangering an impaired or helpless person plus a count each of first-degree death by auto, second-degree assault by auto in a school zone, first-degree vehicular homicide and refusing a DWI test on or near school property, first-degree knowingly leaving the scene of a motor vehicle accident resulting in death and third-degree knowingly leaving an accident resulting in serious bodily injury.

Bunay, an Ecuador native, is being held by an “U.S. Immigration” detainer.

IRVINGTON – A township man and his attorney may not have his four-year-old federal narcotics and weapons possession case dismissed on questions of Acting U.S. Attorney Alina Habba’s status – but has spurred a judge’s review of her reappointment.

Attorney Thomas Mirigliano sought to have the case against his client Julien Giraud, Jr., of Irvington, dismissed by Federal Magistrate Judge Matthew Brann at a Harrisburg, Pa. courtroom Aug. 1.

Mirigliano’s argument was that because the U.S. Justice Department failed to follow the Federal Vacancies Reform Act, which requires a high federal appointee pass Congressional Judiciary Committee hearing and muster, that Habba’s being switched from “interim’ to “acting” attorney July 24-25 was unconstitutional. Habba and her Department of Justice-Newark attorneys should then be barred from prosecuting for the time being.

Judge Brann, in his 10 a.m. Aug. 4 ruling, granted Mirigliano and Giraud a bad news-good news split ruling. The bad news from Brann, in his 27-page ruling, is that Giraud’s case will proceed in Newark -as early as the afternoon of Aug. 4.

“It escapes logic to contend that (Habba’s) appointment somehow retroactively taints the indictment or any aspect of the prosecution that preceded it,” said Judge Brann, “The legality of Habba’s appointment is squarely presented.”

Brann, however, wants to review the legality of U.S. Attorney General Pam Bondi and President Donald J. Trump’s July 24-25 retaining of Habba. Those maneuvers included firing First Assistant Attorney Desiree Leigh Grace – who was selected to succeed Habba by a panel of New Jersey federal judges. He wants respective briefs on his desk from the USDOJ and Giraud’s attorney Aug. 12 and an amicus brief from the Association of Criminal Defense Lawyers of New Jersey Aug. 13.

EAST ORANGE – The case of a city man’s 2022 murder and injury of two others in a Bloomfield store has ended with an Irvington man starting his life sentence plus 45 years in a state prison since Aug. 4.

State Superior Court-Newark Judge Michael J. Ravin sentenced Joseph Ocasio, 29, of Irvington to life plus 45 in the April 10, 2022 shooting of Cristian Perez, 23, of East Orange. A criminal jury convicted Ocasio April 25 of opening fire on Perez in Nitty Sons Variety Store in Bloomfield.

Besides first-degree murder, the jury convicted and Ravin further sentenced Ocasio for attempted murder, aggravated assault and three counts of child welfare endangerment.

Ocasio had also shot Kwame Kemp, 31, of Paterson, in the back and Rahim Teague, 32, of Irvington in the hand. Kemp was left paralyzed. Teague’s three children -seven, nine and 14 years old in 2022, were also in the store.

Christian Lisaldes Perez’s memorial and cremation were held April 17, 2022 at Flynn and Sons Funeral Home in Woodbridge’s Fords section. A daughter, brother, sister and parents were among his survivors.

ORANGE – The late Edgar O. Bury, Jr., 89, who died at his West Orange home July 18, may be as well remembered for his Orange roots as well as for his township residency.

Bury was born to Edgar Bury, Sr., and Helen Warner Bury Feb. 19, 1936. The Burys – including sisters Gail and Pat – would later “Go West.”

According to the Dangler Funeral Home-posted obituary, Bury was an active member of the First Presbyterian Church of Orange here at 420 Main St. When the 291-year-old house of worship closed in 2010, Bury attended Bloomfield’s Brookdale Reformed Church.

Bury graduated from the West Orange High School Class of 1954 with interest in senior year auto mechanics and, as a junior, a Radio Club member. “Gar” married high school sweetheart Elaine Hardee in 1958 and went on to raise Paul, Gary, Phillip and Mary. He became a journeyman with West Caldwell’s Plumbers Local 24 into his retirement.

Bury’s service was held at Dangler, followed by burial at East Hanover’s Restland Memorial Park, July 23. Five grandchildren and five great-grandchildren also survive him. His parents and son Phillip predeceased him.

Memorial donations may be made to St. Jude’s Children’s Hospital.

WEST ORANGE – When Mayor Susan McCartney, the Township Council and the Council Chamber gallery audience left the Municipal Building after their July 22 meeting, they left with the following consensus: We need a full-time planner.

West Orange has a year-old contract with Montclair Nishuane Group – which also serves Orange. Nishuane is the latest “consultant” on a professional services contract. The township has not had a full time person as township planner for at least a decade.

The planner, as an individual or a consultant, is responsible for real estate development oversight to see if the proposed application squares with the township code. That oversight is in consultant with the township’s planning and zoning boards, township elders and environmental committee.

Also, the planner is to ride herd over the Township Master Plan, which is to be reviewed and revised each decade, and, of late, West Orange’s Fair Share Housing Plan. Nishuane, Heyer Gruel & Associates and the township’s collective failure to file its FSHP with the N.J. Department of Community Affairs on June 30 has prompted State Superior Court-Newark Judge Aldo Russo to allow developers to file “Builder’s Remedy” lawsuits against West Orange.

The question is how to go about attaining a full-time individual as township planner.

“Council members have advocated for a full time planner with economic development experience for years and years but the last two mayors haven’t agreed,” said Council President Joe Krakoviak. “So we don’t have this planner as much as we believe that it’s crucial to our future.”

“We the administration put out a Request for Proposal for a full-time planner last year when the council wouldn’t renew the contract with Paul Grygiel,” said Mayor McCartney. “I was thrilled when interviewing The Nishuane Group (and) the planning and zoning boards voted for Nishuane in January 2025 to represent them – who responded to the RFP to prepare the Affordable Housing Plan. The council, however, did not approve the resolution in January 2025.”

SOUTH ORANGE / MAPLEWOOD – Village Mayor Sheena Collum and the council may be receiving a copy of the South Orange-Maplewood School District’s just-approved plan to turf all but a half-acre of Ritzer Field for a “courtesy review” while you read this.

Collum reassured Hixon Place residents at the July 28 council meeting that she will talk with Maplewood Mayor Nancy Adams to get a commitment from the SOMSD Board of School Estimate to bring the school district’s plan before the township’s planning and zoning boards as public hearings. Both mayors,, with some of their elders and educators, make up the BSE.

The SOMSD board chose Ritzer Plan D 2.0 from among four candidates at their July 24 meeting. That $7 million plan calls for creating a dedicated softball diamond and a soccer/softball/lacrosse field to Columbia High School’s northwest. The two-town BSE, which handles the district’s major financial matters, is to give a final say at their Aug. 28 meeting.

Hixon Place residents came to the Village Council to stop the school estimate boards from rubber stamping the Ritzer Field plan. Those across the street from the field are concerned about the plan’s stormwater and lighting features and that the artificial turf will create a “heat island effect.”

MAPLEWOOD UPDATE: Jakhi McCray, 21, is back home after spending July 21 in Brooklyn and after posting $300,000 bail before Federal District Court Magistrate Judge Vera M. Scanlon. McCray, who surrendered himself to authorities, is accused of setting fire to 10 NYPD marked and plainclothes vehicles June 10. He has pleaded not guilty before Scanlon and his attorney, Ron Kuby.

BLOOMFIELD / BELLEVILLE – Sometimes a jurisdiction’s involvement in a crime blotter item – as in a multijurisdictional location, pursuit and arrest through Silver Lake July 21 – is the result of an incident’s spillover.

Belleville and Newark police and Essex County Sheriff’s Officers apprehended a shooting suspect, identified as Ibn Williams, 33, of Newark, behind 161 Franklin St. before midnight that Monday. Williams, who was caught after a foot chase, was found to possess a handgun.

Officers also found a shooting victim some two blocks west on Bloomfield’s Salter Street. That man was admitted to Clara Maass Hospital in stable condition for a gunshot wound to his left hand.

Belleville police were initially investigating a 10:41 p.m. shooting report from 70 Watchung Ave. when their Newark colleagues told them of a shooting at their Stephen Crane Housing Complex and gave them a description of the suspect. BPD units soon joined in a supporting capacity in the Franklin Street pursuit.

An initial investigation has the suspect shooting the victim at Stephen Crane and both running south and west onto Franklin Street in Silver Lake.

MONTCLAIR – Montclair Public Schools’ current 2024-25 school budget is $11 million in debt as told by Superintendent Ruth B. Turner and Interim Schools Business Administrator Dana Sullivan to the Glenfield Middle School Auditorium Town Hall audience here July 30.

Turner and Sullivan, who came aboard July 1, have immediately frozen spending on travel and conferences. They, the Board of Education, its Financing Committee and “a new auditing firm” are working on a corrective action plan as of press time to present the New Jersey Department of Education. Presenting a CAP to state educators in Trenton is a first step recently familiar to those at the East Orange, Belleville and Nutley public schools.

Sullivan alerted Turner after she had found 70 pages of unpaid purchase orders – most dated for 2024-25 but at least one from the Essex Regional Education Services Commission going back to 2019. The Fairfield-based commission, which provides out of district student services, is owed $4.5 million for the just expired school year and another $1.299 million going back seven years.

While ERESC is the largest single creditor, teachers said they are being owed $2.3 million, they and other MPS employees $1.4 million in benefits, $1.2 million for custodial services and utilities, $546,000 for out of district tuition, $447,000 for paraprofessional services and $197,000 in child study team payments.

At the same time, the district had hired additional employees during the last school year. Then-SBA Christina Hunt sent her July 1 resignation to the MBOE June 4 – which the board accepted that night. Hunt, who was the East Orange School District SBA and secretary, served Montclair for three years.

“It became apparent to me very quickly that there were going to be issues,” said Sullivan, “because I could tell by looking at May financials that there wasn’t going to be enough money to cover the June payroll.”

“Those particular bills were not paid in the year they were supposed to be paid – because there was not enough money,” said Turner. “Staff that were not budgeted (for) were added to the budget after the budget’s approval “

GLEN RIDGE – When the late Junaita and Gabriel Nevola moved into 70 Clark St. here in 1958, they found themselves within walking distance from their work, worship, recreation and cultural interests.

Juanita, 94, who died July 1, was within blocks of the Glen Ridge Municipal Building, where she was a longtime secretary in the borough’s tax collection office. Another block or two more, and she would be at the Glen Ridge Woman’s Club and the Golden Circle Club – where she was their president.

Both Juanita and Gabe would walk across Bloomfield Avenue to Bloomfield’s Sacred Heart Church, where he was the church’s musical director. There was the Bloomfield Recreation Center next door, where Gabe would perform with and was president of the Bloomfield Mandolin Orchestra. (Gabe, a World War Two veteran, was a Newark Public Schools music teacher.)

Back home in Glen Ridge, Juanita and Gabe raised Kenneth, Stanley and Joanne Nevola; Anne Catena and Teresa Moyer. They opened their house to 10 grandchildren and eight great-grandchildren.

Services for the former Juanita Vanadia, who was born Nov. 10, 1930, included a July 6 visitation at the O’Boyle Funeral Home and a July 7 Funeral Mass at Sacred Heart. Her remains were laid beside Gabe’s at North Arlington Holy Cross Cemetery. (Gabe, 91, died July 27, 2017.)

NUTLEY – The township’s public school community will be witnessing the end of an era into Jan. 1, when the sun sets on Nutley Public Schools Board of Education member and president Charles W. Kuncinski, Jr. steps down.

Kuncinski, 83, announced on July 28 that he will not be running for NBOE re-election. He cited health issues in calling time on his 30 years’ public service. He will also wind down his teaching job with the New Jersey State Police.

Kuncinski was board member 1982-97 and from 2010 until year’s end. His colleagues selected him as their president seven times and vice president five times.

When current NBOE President Salvatore Ferraro joked during June 30’s dedication of the Lincoln School auditorium in Kuncinski’s name that “you may find ‘CWK’ etched in the moulding somewhere – proof that Charlie’s connection to Lincoln School goes back further then most records show” – he was not off the mark.

“The ultimate Nutley guy,” as Commissioner and former Mauro Tucci, Sr. called Kucinski, was born among three generations of Nutleyites in December 1941. His grandmother opened Kucinski’s Bakery on Franklin Avenue in 1920. Father Charles, Sr., sister Mary Ann and his two daughters also navigated Nutley Public Schools.

“Chuck” was promoted from Lincoln Elementary and Nutley Junior High School to become among the Nutley High School Class of 1959. That year’s “Exit” yearbook lists him as eyeing “a career in the Navy” – which he did in the Vietnam War. The then-Montclair State College education graduate married his wife Lorraine Bini Kucinski here and was a 34-year firefighter.

TOWN WATCH NEWARK – A Newark resident remains in the Essex County Correctional Facility on state charges and a federal detainer since July 29 while relatives of the woman he killed in front of a Newark Public School July 28 are making her funeral arrangements.
