NEWARK<\/strong> – Mayor Ras Baraka and Gov. Mikie Sherrill’s latest efforts to diffuse and disable confrontations between demonstrators and federal agents in front of the Delaney Hall detention center may have results as early as June 2 past “Local Talk” filing deadline.<\/p>\n\n\n\n

Baraka and New Jersey Attorney General Jennifer Davenport filed a joint civil lawsuit against hall operator GEO Group in State Superior Court-Newark Tuesday afternoon. The filing is calling for a court injunction and show cause order to bring N.J. Department of Health inspectors into the 1,000-bed facility here at 451 Doremus Ave.<\/p>\n\n\n\n

The DOH inspectors, if or when they gain full access, will see for themselves the conditions described by those detained by GEO, the U.S. Department of Homeland Security and their agents. The letter told of overcrowding, sparse hygiene supplies and spoiled food. The detainees said they are being denied access to medicine, visits by relatives, computers and phones to call their lawyers – sometimes in retribution for the letter and hunger strike.<\/p>\n\n\n\n

The 300, who had the open letter smuggled out May 22, had gone on a hunger strike that same Friday.<\/p>\n\n\n\n

GEO, acting on behalf of its DHS client, allowed limited access May 28 to DOH inspectors. The inspectors, however, were barred from looking into the medical unit, sleeping and bathing areas, or toilets.<\/p>\n\n\n\n

U.S. Senator Andy Kim (D-Moorestown) and Cong. Rob Menendez (D-Union City) were allowed into the hall May 23 and met with some of the detainees. One pregnant woman said that she has had no obstetrical or gynecological care since her detainment; another said that she had to manage her miscarriage on her own.<\/p>\n\n\n\n

That open letter brought more demonstrators to the Ironbound’s east end, resulting in near daily clashes with Immigration and Customs Enforcement and Customs and Border Protection agents, federal marshals, security guards hired by GEO and, lately, New Jersey State Police and Newark Police Division officers.<\/p>\n\n\n\n

Sherrill (D-Montclair), who was personally denied Delaney access May 25, ordered State Police troopers to stand between the federal agents and demonstrators May 31. That Sunday was also when Baraka, with consultation from Newark Public Safety Director Emanuel Miranda, Sr., ordered a 9 p.m.-6 a.m. nightly curfew in a half-mile radius of 451 Doremus Ave. plus assigned “fall back” protest areas. (That curfew may be called off by presstime.)<\/p>\n\n\n\n

“As I said repeatedly, refusing to provide full access raises serious questions about what ICE is trying to hide from public view,” said Sherrill May 28. “New Jersey believes in the rule of law, upholds the Constitution and Delaney Hall should be closed down. I’m calling on ICE to immediately de-escalate the situation while I work to keep New Jersey residents safe.”<\/p>\n\n\n\n

Baraka, in Tuesday’s court injunction, reminded the public that he would pursue closing Delaney Hall in an injunction should DOH inspectors not gain access.<\/p>\n\n\n\n

“This is not federal property; these are not federal grounds,” said the mayor. “It’s a private facility, private workers and they are subject to state and municipal laws.”<\/p>\n\n\n\n

NPD officers, however, have replaced state troopers in separating the confrontational parties since that night. Troopers, who announced the curfew’s 9 p.m. start, granted 30 minutes’ grace for the protestors to leave.<\/p>\n\n\n\n

When the demonstrators did not depart, troopers – some in riot gear, began detaining and arresting violators. an estimated 20 protestors were taken to Newark police precinct booking, adding to at least 61 people having been arrested since May 22.<\/p>\n\n\n\n

Newark has joined Minneapolis-St. Paul, Los Angeles, Chicago and Portland, Ore. on the list of flash points over ICE agents’ arrests, detention and deportation without due process and increasing impunity since Jan. 20, 2025.<\/p>\n\n\n\n

New Jersey’s largest city – and the detention center on its farthest east side – has been the subject of reports and commentary aired by the likes of Fox News, MS-Now and the BBC World Service.<\/p>\n\n\n\n

Federal government spokespersons have been saying that GEO is operating Delaney normally, that conditions and services within are better than what detainees would get in their “home countries” or what “most U.S. prisoners receive.”<\/p>\n\n\n\n

The federal administration representatives add that there is no hunger strike and, if there was one, some of the participants have been shipped out to other contracted DHS facilities.<\/p>\n\n\n\n

Federal “Border Czar” Tom Homan was said to have made an unannounced visit to Delaney Hall May 30. Sources told NBC-TV that he had dined on “the same food given detainees.”<\/p>\n\n\n\n

“He’s the border czar,” replied Baraka. “I’m sure he had good food.”<\/p>\n\n\n\n

President Donald J. Trump, in a May 27 cabinet meeting, called the protestors “fake, they’re all paid for. They have the same printed signs, printed from somewhere. We run the finest facilities anywhere in the world of their type.”<\/p>\n\n\n\n

There is a line of debate where a small group of funded professional protestors travel from one conflict area to another to agitate. The State Police had noted that a majority of the 20 arrested for curfew violations May 31 were from outside New Jersey.<\/p>\n\n\n\n

There is also a small contingent of counter protestors, supporting ICE and the Trump Administration present.<\/p>\n\n\n\n

The clashes brought some “noncombatants” into the crossfire last weekend. There was a private trash hauler, for example, who was detained by demonstrators at the gate. One local television news crew who were ordered by agents to vacate their van – and walked into a tear gas cloud.<\/p>\n\n\n\n

DHS, on May 30, said state and local officials, had immediately restored family visitation for the detainees.<\/p>\n","protected":false},"excerpt":{"rendered":"
